Terms of Service

These Terms of Service ("Terms") govern access to and use of Cyclize, a marketing operations platform operated by Alevated and The Marketing Pros ("Cyclize," "we," "us," or "our"). By accessing this website or using Cyclize products and services, you agree to these Terms.
1. Use of Cyclize
Cyclize is designed for agencies, operators, and authorized business users managing content, social, and paid-media workflows for client or owned brands. You may use Cyclize only for lawful business purposes and in accordance with these Terms, applicable platform policies, and any separate agreement between you and us.
2. Accounts and authorization
You are responsible for ensuring that you have the right to connect, manage, or submit instructions for any brand, advertising account, social account, website, or marketing platform you authorize us to access. You are responsible for the accuracy of information you provide and for maintaining appropriate permissions with third-party platforms.
3. Connected platforms
Cyclize may integrate with third-party platforms such as Google Ads, Meta, LinkedIn, YouTube, and other marketing, analytics, or publishing services. Your use of those platforms remains subject to their own terms, policies, permissions, and review processes. We are not responsible for outages, policy decisions, account restrictions, or changes made by third-party platforms.
4. Human approval for paid-media actions
Cyclize may help generate campaign drafts, recommendations, pacing alerts, and performance reports. For paid media workflows, new campaign launches and budget increases require explicit human approval before execution. You remain responsible for approving budgets, campaign strategy, advertising claims, targeting, and compliance with applicable advertising rules.
5. Acceptable use
You may not use Cyclize to:
- Violate laws, regulations, platform policies, intellectual property rights, or privacy rights.
- Submit deceptive, misleading, harmful, discriminatory, or unlawful advertising or content.
- Attempt to gain unauthorized access to systems, accounts, credentials, or data.
- Interfere with the security, availability, or integrity of Cyclize or third-party platforms.
- Use Cyclize to send spam, scrape unauthorized data, or bypass platform review or enforcement systems.
6. Customer content and data
You retain ownership of content, brand materials, account data, and instructions you provide to Cyclize. You grant us the rights necessary to process that information to provide, maintain, secure, and improve Cyclize and related services. You represent that you have the rights and permissions needed to provide that content and data to us.
7. Reports, recommendations, and outputs
Cyclize may produce reports, recommendations, drafts, and other outputs. Outputs are provided for operational support and decision-making. You are responsible for reviewing and approving outputs before publication, submission, or reliance, especially where outputs affect advertising spend, legal claims, healthcare claims, regulated industries, or client-facing communications.
8. Fees and services
Fees, billing terms, scopes of work, and service levels may be governed by a separate agreement, order, proposal, or statement of work. If there is a conflict between these Terms and a signed written agreement, the signed agreement controls for the conflicting subject matter.
9. Confidentiality and security
Each party may receive confidential business, technical, marketing, or account information. Each party agrees to use reasonable care to protect confidential information and to use it only for the purposes of the relationship. We maintain reasonable safeguards designed to protect systems and data, but no system can be guaranteed to be completely secure.
10. Disclaimers
Cyclize is provided on an "as is" and "as available" basis except as expressly stated in a separate written agreement. We do not guarantee uninterrupted service, specific advertising results, platform approval, conversion volume, revenue, cost-per-lead, or account status. Marketing performance depends on many factors outside our control.
11. Limitation of liability
To the maximum extent permitted by law, Cyclize, Alevated, The Marketing Pros, and their affiliates will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or for lost profits, lost revenue, lost data, or business interruption arising from use of Cyclize.
12. Indemnity
You agree to indemnify and hold us harmless from claims, losses, liabilities, damages, costs, and expenses arising from your content, your instructions, your connected accounts, your violation of these Terms, or your violation of applicable laws or third-party platform policies.
13. Suspension and termination
We may suspend or restrict access to Cyclize if we believe continued access creates security risk, legal risk, platform-policy risk, nonpayment risk, or harm to us, you, clients, users, or third parties. You may stop using Cyclize at any time, subject to any separate agreement that applies.
14. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of Cyclize after updates means you accept the updated Terms.
